Abstract

People cannot escape from society. Even if was just indigenous society. The community has distinctive characteristics that shape togetherness in the community to bound them all. In such people, there were specialties that the law should provide protection. Likewise, for Lasem’s Batik maker which holds a regional characteristic. Its regional characteristic cannot be protected unless there was merely cooperation among each party that had involved protecting it. To protect Lasem’s characteristic cannot handed only to the local association in Lasem. Government should take more action rather than all of the actions recently. Government should provide all the Lasem’s batik maker with a basic of law knowledge so by that, it can protect their local indigenous geography. This research is using a descriptive analytical trough The Law Number 20 of 2016 year concerning about Trade Mark and Indigenous Geography with a literature studies to other positive law in Indonesia that may relevant to intellectual property rights. This research will provide a description of the Intellectual Property Protection System (hereinafter referred to as KI) which will be match to apply in Lasem society alongside the majority problems that occurs in there. The approach that used in this study is a qualitative approach, supported by a conceptual approach also provided simple random interview with the Lasem’s batik maker. A Qualitative descriptive approach is carried out by conducting research on KI literature and library materials. The primary data used in this study are KI Law books and KI journals. The results of this research prove that Lasem’s Batik Maker did not absorbed the concept of KI protection as the Copyright Act, the Trademark Law. So by that, it is almost impossible to create An Indigenous geography of Lasem’s Batik Cultural. Thus, the concept of Lasem batik as a communal can be considered to be useless than optimal. It will needed an ongoing effort to provide counseling and service is needed to assist The Lasem’s Batik community.
