Abstract

New invention in many fields, makes human activities become more easy, including a new way to collect donation, by using an online platform. It is used massively by people, and potentially inflict misuse of funds. This article will discuss how the Indonesian Regulation System regulates donation based-online crowdfunding, and how the legal system gives legal protection for donation giver, in case there is a misuse of funds. The goal of this research is to analyze legal protection which is guaranteed by law for donation giver who has given their funds through an online platform. This article is a result of normative juridical research with statutory and conceptual approaches. The conclusions are donation-based crowdfunding activities in Indonesia is technically regulated by Minister for Social Affairs Regulation of the Republic of Indonesia No. 11 Year 2015, while regulation regarding the prosecution mechanism of misuse of funds still not yet available. For protecting donation giver, platform administrator or management have to publish their financial report, and also the campaigners have to report to the donation giver, that the fund has successfully given to the intended party.
