Abstract

In order to realize the society’s welfare as stated constitutionally in Republic of Indonesia, the government needs to develop a strategic policy related to Micro, Small and Medium Enterprises (MSME’s). MSME’s has been regulated by Undang-Undang No.20/2008 tentang Usaha Mikro, Kecil dan Menengah as the legal protection, aside from other legislation. However, the implementation of MSME’s development in Indonesia still experiencing various problems, such as accessibility, management, capital, technology, raw materials, information and marketing, infrastructure, bureaucracy and taxes, as well as partnerships. This research use juridical normative analytical description as well as legislation and conceptual approaches. The data used in this research are secondary data supported by the primary data. The results of the research showed that in the development of MSME’s in Indonesia, legal instrument is required as a foundation and reference to solve the problems experienced by MSME’s during the implementation.
